Diego Gallagher - Associate
Diego is an Associate Solicitor in the firm's Health Services Department. He has extensive experience representing and advising the Health Service Executive in relation to health care and child care law. Diego gives advice in reIation to child protection, mental health, and adoption. Diego has extensive Court experience and has made applications in person in the District Court, Circuit Court, High Court, Coroners Court and he has also appeared before the Adoption Board. Diego provides training and lecturing in healthcare law to clients.
Key case experience
- Advising in relation to District Court and High Court applications to place children in residential care facilities and foster care in the United Kingdom.
- Advising In relation to judicial review proceedings taken on behalf of an involuntary patient in a psychiatric hospital to procure access to the District Court for the purposes of defending Child Care proceedings under the Childcare Act 1991.
- The successful prosecution of a newspaper under section 31 of the Childcare Act 1991 for breaching the prohibition on publishing information likely to identify children subject to proceedings under the 1991 Act.
- Successfully applying under section 25 of the Mental Health Act 2001 to place a 17 year old child in a psychiatric hospital.
Qualifications
- LLB (Hons), Trinity College Dublin.
- Diploma in Basic Spanish. University of Salamanca.
- Certificate in Legal Spanish. Law Society of Ireland.
